AFFILIATE PROGRAM - TERMS & CONDITIONS

OVERVIEW

These Terms and Conditions ("Terms") govern participation in the Wealth Horizons Academy Affiliate Partner Program ("Program"). By applying to, accessing, or participating in the Program, you ("Affiliate") agree to be bound by these Terms in addition to the Wealth Horizons Academy Affiliate Partner Agreement.

Wealth Horizons Academy ("WHA," "we," "us," or "our") reserves the right to update these Terms at any time. The most current version will always be available at https://www.wealthhorizonsacademy.org/pages/affiliate-terms. Continued participation in the Program after any update constitutes your acceptance of the revised Terms.

1. ELIGIBILITY

1.1 Who Can Apply

The Wealth Horizons Academy Affiliate Program is open to the general public. Anyone who meets the following requirements may apply:

You are at least 18 years of age
You have a valid email address
You have at least one active social media account, website, blog, podcast, or other promotional channel
You agree to comply with all applicable laws and these Terms
You are not a current WHA employee or immediate family member of a WHA employee

1.2 Geographic Restrictions

The Program is open to participants worldwide, except residents of countries subject to U.S. trade sanctions, embargoes, or export restrictions. WHA reserves the right to restrict participation from specific regions at its sole discretion.

1.3 Disqualification

WHA reserves the right to reject any application or disqualify any existing Affiliate at any time, without obligation to provide a reason, including for:

Providing false or misleading information during application
Prior violations of WHA terms or policies
Engaging in prohibited conduct (see Section 7)

2. HOW TO JOIN

2.1 Application Process

To join the Program:

Complete the affiliate application form at https://www.wealthhorizonsacademy.org/pages/affiliate-apply
Provide accurate information including your name, email, and promotional channel(s)
Read and agree to the Affiliate Partner Agreement and these Terms
Submit your application for review

2.2 Approval

Applications are reviewed on a rolling basis. You will receive an email notification of approval or rejection. WHA does not guarantee approval of any application.

2.3 Upon Approval - What You Receive

Once approved, you will receive:

✅ Your unique affiliate tracking link
✅ Access to your personal affiliate dashboard
✅ Your Affiliate Welcome Kit, including:

- 3 professionally written promotional scripts

- 3 ready-to-post promotional videos featuring Katrina, WHA's brand spokesperson

- Social media posting guidelines

- FTC disclosure guide

- Branded promotional materials

3. COMMISSION STRUCTURE

3.1 Commission Rate

Approved Affiliates earn 50% commission on the net sale price of every qualifying product sold through their unique affiliate link.

3.2 What Qualifies as a Commission

A commission is earned when:

A customer clicks your unique affiliate link
The customer completes a purchase within the 30-day cookie window
The sale is not subsequently refunded or charged back within the hold period
The customer is not an existing WHA customer (new customers only)

3.3 Affiliate Purchase Discount

Active Affiliates in good standing receive a 10% discount on all Wealth Horizons Academy products they purchase for personal use. This discount:

Is applied to direct purchases only (not through your affiliate link)
Is non-transferable
Cannot be combined with other promotions unless stated by WHA
Is available while your affiliate account remains active and in good standing

3.4 Commission Exclusions

Commissions are not earned on:

Your own purchases made through your affiliate link
Taxes, fees, or government-imposed charges
Refunded or charged-back transactions
Purchases made outside your cookie window
Fraudulent or manipulated transactions

3.5 Products Available for Promotion

All 63 active Wealth Horizons Academy products are available for affiliate promotion, spanning categories including:

Real Estate Education & AI Tools
Financial Markets & Trading Education
Wealth Building & Mindset Programs
Medical Billing Business Systems
Legal Practice Management
Cybersecurity Training

A complete, up-to-date product catalog is available in your affiliate dashboard.

4. TRACKING AND COOKIE POLICY

4.1 Your Affiliate Link

Each Affiliate receives a unique tracking URL. You must use this link in all promotional content to receive credit for referrals. Do not alter, mask, or manipulate your affiliate link.

4.2 Cookie Window

Affiliate cookies are active for 30 days from the date a visitor clicks your affiliate link. If the visitor completes a purchase within that 30-day window, you receive the commission.

4.3 Attribution

WHA uses last-click attribution. If a customer clicks multiple affiliate links before purchasing, the commission is awarded to the most recently clicked affiliate link.

4.4 Tracking Limitations

WHA strives to maintain accurate tracking but is not liable for missed commissions caused by:

Customer use of browser cookie blockers or private/incognito browsing
Customer ad blockers or privacy software
Incorrect deployment of affiliate links by the Affiliate
Technical outages or interruptions beyond WHA's control

4.5 Dispute Window

Commission tracking disputes must be submitted within 14 days of the transaction date via your affiliate dashboard or by emailing success@wealthhorizonsacademy.org.

5. PAYMENTS

5.1 Payment Schedule

Commissions are paid monthly, on or before the 15th of each month, for qualifying sales from the prior calendar month that have cleared the hold period.

5.2 Minimum Payout Threshold

The minimum payout amount is $50.00 USD. Commissions below this threshold roll over to the following month.

5.3 Hold Period

All commissions are held for 30 days from the sale date to allow for refunds and chargebacks before payment is released.

5.4 Refund Policy Impact

If a customer you referred requests a refund within WHA's refund window, the associated commission will be reversed. If payment has already been made, the reversed amount will be deducted from future payments.

5.5 Payment Methods

Commissions are paid via PayPal. You are responsible for maintaining a current and accurate PayPal account and providing your PayPal email address in your affiliate dashboard.

5.6 Currency

All commissions are paid in U.S. Dollars (USD).

5.7 Taxes

You are solely responsible for reporting and paying all applicable taxes on commissions earned. WHA will issue tax documents (e.g., IRS Form 1099-NEC) as required by law. You must provide requested tax information (W-9 or W-8BEN) upon request. Failure to provide tax documents may result in payment suspension.

6. REQUIRED DISCLOSURES - FTC COMPLIANCE

6.1 Legal Requirement

United States law (FTC 16 C.F.R. Part 255) requires that you clearly disclose your material connection to WHA whenever you promote our products. This is not optional. Failure to disclose is illegal and constitutes a breach of these Terms.

6.2 Required Disclosure Language

You must include a disclosure that is clear, prominent, and placed before your affiliate link. The following language (or substantially similar wording) is required:

"I may earn a commission if you purchase through my link. This is an affiliate partnership with Wealth Horizons Academy."

6.3 Platform-Specific Disclosure Rules

Email	Clear disclosure above the affiliate link

Podcast	Verbal disclosure before mentioning the product

6.4 Penalties for Non-Compliance

The FTC can impose fines of up to $43,792 per violation for non-compliant affiliate marketing. WHA will also terminate the affiliate account of any Affiliate found to be non-compliant. WHA is not responsible for fines or penalties imposed on Affiliates for their own non-compliance.

7. PROHIBITED CONDUCT

The following activities are strictly prohibited and will result in immediate account termination and forfeiture of all pending commissions:

7.1 Deceptive Marketing

Making false, misleading, or unsubstantiated claims about WHA products
Guaranteeing specific income, profit, or financial results
Creating fake testimonials, fabricated reviews, or false social proof
Implying celebrity, government, or third-party endorsements without authorization

7.2 Fraudulent Activity

Cookie stuffing or any manipulation of tracking systems
Generating fake clicks, impressions, or transactions
Creating multiple affiliate accounts
Using automated bots or scripts to generate traffic

7.3 Unauthorized Advertising

Running paid search ads (Google, Bing, etc.) on WHA brand keywords without written approval
Running paid social media ads targeting WHA brand terms without written approval
Bidding on "Wealth Horizons Academy" or any confusingly similar brand term in paid advertising

7.4 Spam and Unsolicited Marketing

Sending unsolicited bulk email (spam) to promote WHA products
Using purchased, rented, or harvested email lists
Cold-messaging individuals on social media without their prior consent

7.5 Brand Misuse

Registering domain names or social handles containing "Wealth Horizons Academy" or similar
Creating sites or profiles that could be confused with official WHA properties
Altering or modifying WHA-provided promotional materials without written approval
Using WHA branding outside the scope permitted in the Affiliate Partner Agreement

7.6 Inappropriate Platforms

Promoting WHA products on platforms or within content that includes:

Adult or sexually explicit content
Gambling or wagering
Hate speech, discrimination, or harassment
Illegal activities or products
Any content that violates applicable laws or platform terms of service

7.7 Incentivized Purchasing

Offering cash back, unauthorized discounts, or other incentives to customers to purchase through your affiliate link without WHA's prior written consent

8. EARNINGS DISCLAIMER

Results Are Not Typical.

Any income figures, earnings examples, or commission estimates discussed in WHA promotional materials, training, or communications are illustrative only and do not represent typical results. Individual results will vary significantly based on:

Personal effort and time invested
Marketing skills and reach
Audience size and engagement
Market conditions and competition
The specific products promoted
Numerous other factors outside WHA's control

Wealth Horizons Academy does not guarantee that any Affiliate will earn any specific amount, or any amount at all, through participation in the Program.

Participation in the Affiliate Program does not constitute an investment and does not guarantee returns. The Program is a performance-based marketing arrangement where compensation is earned only upon the generation of qualifying sales.

9. INTELLECTUAL PROPERTY

9.1 WHA Materials License

WHA grants you a limited, non-exclusive, non-transferable, revocable license to use approved WHA trademarks, logos, videos, scripts, and other promotional materials ("WHA Materials") solely to promote WHA products in accordance with these Terms.

9.2 Restrictions

You may not:

Edit, alter, or create derivative works from WHA Materials without written approval
Use WHA's brand name, logo, or trademarks in your own business name or domain
Sub-license or transfer WHA Materials to any third party
Use WHA Materials after your affiliate account is terminated

9.3 Your Content

You retain ownership of original promotional content you create. By creating content that features WHA brand elements, you grant WHA a royalty-free license to share and feature that content for promotional purposes.

10. PROGRAM MODIFICATIONS AND TERMINATION

10.1 Program Changes

WHA reserves the right to modify any aspect of the Affiliate Program at any time, including:

Commission rates (30 days advance notice)
Cookie window duration
Product availability and pricing
Payment terms and thresholds
Eligible promotional channels

10.2 Account Termination by WHA

WHA may suspend or terminate your affiliate account:

With 30 days notice for convenience
Immediately for violation of these Terms, the Affiliate Partner Agreement, or applicable law

10.3 Account Termination by Affiliate

You may close your account at any time by emailing success@wealthhorizonsacademy.org. Upon closure, your affiliate link will be deactivated and any earned commissions that have cleared the hold period will be paid on the next scheduled payment date.

10.4 Effect of Termination

Upon termination:

Your affiliate link is deactivated immediately
You must cease all use of WHA Materials
No commissions are earned on sales after termination
Pending commissions subject to holds or refunds remain subject to reversal

11. PRIVACY AND DATA

11.1 Your Data

By participating in the Program, you agree to WHA's Privacy Policy available at https://www.wealthhorizonsacademy.org/pages/privacy-policy. WHA collects and processes your personal data to administer the Program, calculate commissions, and make payments.

11.2 Customer Data

You may not collect, store, or use personal data belonging to WHA customers obtained through the Program. Customer data belongs exclusively to WHA.

11.3 GDPR/CCPA

If you promote WHA products to audiences in the European Union or California, you are independently responsible for compliance with applicable data protection regulations (GDPR, CCPA) in your own marketing activities.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR PARTICIPATION IN THE AFFILIATE PROGRAM. WHA'S TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL COMMISSIONS PAID TO YOU IN THE THREE MONTHS PRIOR TO THE CLAIM.

You agree to indemnify and hold WHA harmless from any claims, damages, or expenses arising from your promotional activities, your breach of these Terms, or your violation of any applicable law.

13. GOVERNING LAW

These Terms are governed by the laws of the State of Ohio, United States. Any disputes shall be resolved through binding arbitration as set forth in the Affiliate Partner Agreement.

15. ACKNOWLEDGMENT

By applying to or participating in the Wealth Horizons Academy Affiliate Program, you confirm that:

✅ You have read and understand these Terms & Conditions in full
✅ You agree to comply with all FTC disclosure requirements
✅ You understand that commissions are earned only on qualifying sales
✅ You understand that income results are not guaranteed
✅ You are legally permitted to enter into this agreement in your jurisdiction
